Terms of Service

These terms govern your use of Turnkey Oceanfront Ownership websites, landing pages, chat experiences and related informational services.

1. Acceptance of These Terms

By accessing or using websites, landing pages, forms, chat widgets or related services operated by Dave Richardson Inc. (collectively, the “Services”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Services.

2. Informational Purpose

The Services provide general information concerning Maui real estate, property ownership and related resources. Website content is provided for informational purposes only and may be changed or withdrawn at any time.

Using the Services, submitting an inquiry or participating in an introductory call does not create a broker-client, agency, fiduciary, advisory or other professional relationship. Any real estate representation must be established through a separate written agreement with the applicable licensed real estate brokerage.

3. Real Estate Information

Property descriptions, prices, availability, rental history, projections, zoning, association rules and other listing information may come from third-party sources and may change without notice. Although we aim to provide useful and accurate information, we do not warrant that any listing or property information is complete, current or error-free.

You are responsible for conducting appropriate due diligence and reviewing material facts, contracts, public records, zoning, permits, association documents, insurance, financing and other matters with qualified professionals before making a real estate decision.

4. No Financial, Tax or Legal Advice

Nothing in the Services constitutes legal, tax, accounting, investment or financial advice. References to income, expenses, financing, appreciation, equity, rental performance or ownership structures are illustrative and are not promises or guarantees of results. Consult your own licensed advisers regarding your circumstances.

5. Communications and Non-Marketing Text Messages

If you separately provide your mobile number and opt in, you agree that Dave Richardson Inc. may send non-marketing text messages concerning your inquiry, requested appointment, conversation or service updates.

We do not send marketing or promotional text messages under this program. Marketing messages would require separate consent. Wireless carriers are not liable for delayed or undelivered messages. Please review our Privacy Policy for information about how mobile data and consent are handled.

6. Acceptable Use

You agree not to misuse the Services, interfere with their operation, attempt unauthorized access, introduce malicious code, scrape or harvest information unlawfully, impersonate another person, or use the Services in violation of any applicable law.

7. Intellectual Property

Unless otherwise stated, the text, design, branding, graphics and other original content presented through the Services are owned by or licensed to Dave Richardson Inc. You may view and print content for your personal, noncommercial use. No other reproduction, distribution, modification or commercial use is permitted without prior written authorization.

8. Third-Party Services and Links

The Services may contain links to property platforms, brokerages, lenders, managers, publications and other third parties. Those resources are provided for convenience. We do not control and are not responsible for third-party content, availability, policies or services. An introduction or link does not eliminate your responsibility to evaluate that third party independently.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, a particular property outcome, rental income, appreciation, financing approval or transaction result.

10. Limitation of Liability

To the fullest extent permitted by law, Dave Richardson Inc. and its officers, employees, contractors and agents will not be liable for indirect, incidental, special, consequential or punitive damages arising from or related to the Services or your reliance on website information. Nothing in these Terms excludes liability that cannot lawfully be limited.

11. Governing Law

These Terms are governed by the laws of the State of Hawai‘i, without regard to conflict-of-law rules. Any dispute not subject to another binding written agreement shall be brought in a court of competent jurisdiction in Maui County, Hawai‘i.

12. Changes and Severability

We may update these Terms from time to time by posting a revised version with a new effective date. If any provision is found unenforceable, the remaining provisions will remain in effect.
